These terms apply to the use of yorkproducts.ca and to goods and services supplied by York Products. If you are ordering on behalf of a company or other organization, you confirm that you are authorized to place the order and bind that organization. If you are a consumer, nothing in these terms limits or waives a right or remedy that cannot lawfully be limited or waived under applicable consumer protection law.
1. What we supply
York Products manufactures and supplies custom sliding doors, glazing, mirrors and privacy film, and provides emergency glass and board-up services in the Greater Toronto Area. Product descriptions, images and gallery photographs are illustrative. Glass, mirror, finishes and other materials may vary naturally in colour, texture, reflection and appearance. Reasonable variations that do not affect the agreed specifications or performance are not defects.
2. Online orders — made to measure
Everything ordered through our online configurator is manufactured to the measurements and options you provide.
Your measurements. You are responsible for the measurements you enter. We manufacture the product to the measurements and specifications in the order we accept. We publish a measuring guide and encourage you to use it. If you are unsure about a measurement or configuration, contact us before placing the order.
Price. The price shown by the online configurator is based on the options, measurements and quantities selected. Before you enter into the order, the checkout will show the applicable itemized charges, applicable taxes, and the total amount payable. Unless expressly stated otherwise, prices are in Canadian dollars. If we identify an obvious pricing or calculation error, we may correct it before the order is accepted, and we will give you an opportunity to accept or decline the corrected order.
Acceptance and payment. The final checkout page will give you an opportunity to review the order, correct errors and accept or decline the agreement immediately before payment. Your order is accepted when you complete the final order process and York confirms acceptance of the order. Payment is processed through Stripe. If York cannot accept or fulfil an order after payment has been taken, York will notify you and refund the amount paid.
Pickup and installation. Online orders are pickup only from our Concord location. Online-order pricing does not include installation, and York does not provide installation as part of an online order. Online delivery is not offered through the website; if you need delivery, contact us and we may quote delivery separately.
Pickup and storage. We will contact you when the order is ready and arrange a pickup time. Please collect the order within 30 days after we tell you that it is ready. After that period, we may charge reasonable storage costs after notifying you of the applicable charge.
3. Cancellation, changes, defects and returns
Custom, made-to-measure goods are manufactured specifically to your measurements and selections and generally cannot be resold. Subject to any rights you have under applicable law:
- You may request cancellation or a change before manufacturing begins. We will confirm whether manufacturing has begun and what, if anything, can be changed or refunded.
- Once manufacturing has begun, an order for correctly manufactured custom goods generally cannot be cancelled, returned or refunded because you have changed your mind or no longer require the goods.
- This restriction does not apply where the goods are defective, materially different from the order we accepted, or where cancellation, refund or another remedy is required by applicable law.
Nothing in these terms limits or waives rights or remedies available to a consumer under the Ontario Consumer Protection Act, 2002 or other applicable law.
If something is wrong with an order, contact us promptly after pickup and provide photographs or other information that will help us assess the issue. If we manufactured the goods incorrectly or the goods have a manufacturing defect, we will work with you on an appropriate remedy, which may include repair, replacement or refund, subject to applicable law.
4. Project work — measured and quoted
For glazing, mirrors, privacy film and larger projects: we normally attend the site to measure before preparing a quote; a quote is based on the measurements and site conditions observed and the work and materials identified in it; quotes are valid for 30 days unless the quote states otherwise. A deposit is required before work or manufacturing begins — the amount of the deposit and any cancellation or refund terms will be stated in the applicable quote or project agreement — and the balance is due on completion unless we agree otherwise in writing.
Project timelines depend on the size and nature of the project and typically range from a few days to several weeks. Any date we provide is a good-faith estimate unless the applicable written agreement expressly states otherwise, and timing may change because of material availability, site access, weather, site conditions or other circumstances outside our reasonable control.
Our quote assumes safe and reasonable access and that the opening, structure and surrounding conditions are suitable for the proposed work. If we discover conditions that were not reasonably apparent when we measured and that materially affect the work or price, we will explain the issue before proceeding with the affected additional work and seek your approval where appropriate.
Where applicable consumer-protection law imposes additional requirements on a project agreement, those requirements apply.
5. Emergency service
Our emergency service is intended to secure damaged openings as quickly as reasonably possible, 24 hours a day, across the Greater Toronto Area.
- The initial attendance is generally intended to secure the opening, usually by boarding it. Permanent glass replacement is normally scheduled afterwards and may be quoted separately.
- Because emergency work must sometimes begin before the full scope can be assessed, we may attend without providing a complete repair quote beforehand. Before dispatch, we will communicate the applicable call-out basis or charges to the extent reasonably possible in the circumstances. We invoice for the work performed and materials supplied.
- Response and arrival times depend on distance, traffic, weather, workload, availability of personnel and other circumstances. We do not guarantee a particular arrival time.
- Our emergency telephone line is intended to be answered and used to arrange dispatch at any hour, subject to telecommunications outages and circumstances outside our reasonable control.
- You confirm that you are the owner of, or are authorized to instruct work at, the property.
6. Business accounts and the client portal
Business clients and their authorized contractors may be given access to our online ordering portal. You are responsible for maintaining the confidentiality of account credentials and for orders placed through your account, and must promptly notify us if you believe your account has been accessed without authorization. Pricing, credit terms and other arrangements specific to a business account may be governed by a separate written agreement; if that agreement conflicts with these terms, the separate written agreement controls to the extent of the conflict.
7. Warranty
Subject to applicable law, we warrant that our workmanship and goods manufactured by York will be free from defects in materials and workmanship for 12 months from pickup or completion, when used normally and maintained in accordance with applicable care instructions.
The warranty does not cover damage caused by accident, misuse, abuse, alteration, improper maintenance, normal wear and tear, improper installation by others, or other causes unrelated to a manufacturing or workmanship defect. Goods installed by anyone other than York, including self-installation of an online order, remain covered for manufacturing defects to the extent provided by this warranty, but York is not responsible under this warranty for defects or damage caused by the installation itself.
This warranty is in addition to, and does not exclude or limit, any statutory warranty, condition or remedy that cannot lawfully be excluded or limited.
8. Limitation of liability
To the fullest extent permitted by law, York will not be liable for indirect, incidental, special or consequential losses arising from an order or service, including loss of profit or loss of use. Subject to applicable law, York's aggregate liability arising from a particular order or service will not exceed the amount paid to York for that order or service.
Nothing in these terms excludes or limits liability or a remedy that cannot lawfully be excluded or limited, including rights and remedies available to consumers under applicable consumer protection law. In particular, no limitation in these terms is intended to exclude liability for death or personal injury caused by negligence where such exclusion is prohibited by law.
9. Website use and intellectual property
The content of this website, including text, photographs, project images, product information and the configurator, belongs to York Products or its licensors. You may view and use the site for lawful personal or business purposes connected with considering or purchasing York's products and services. You may not copy, reproduce or commercially reuse website content without permission, interfere with the operation or security of the site, extract website data in bulk, or use the site for an unlawful purpose.
Prices, availability and product information may change. Changes do not affect an order that York has already accepted except as permitted by the applicable agreement or law. Third-party names, brands and project references appear with permission where applicable and remain the property of their respective owners.
10. Privacy
Our handling of personal information is described in our Privacy Policy.
11. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario. The courts of Ontario have jurisdiction, subject to any rights a consumer has under applicable law to bring a proceeding elsewhere or to exercise a statutory right in another forum.
